MARKETING OF FRUIT JUICES AND CERTAIN SIMILAR PRODUCTS
European Communities (Marketing of Fruit Juices and Certain Similar Products)(Amendment) Regulations 2010 (S.I. No 609 of 2010)
Summary: This amending SI transposed Directive 2009/109/EC which amended the rules regarding fruit juice. It takes account of developments in relevant international standards, in particular the Codex Standard for fruit juices and nectars (Codex Stan 247-2005) which was adopted by the Codex Alimentarius Commission during its 28th session on 4-9 July 2005 and the Code of Practice of the European Fruit juice Association (AIJN).
The Codex Standard lays down that the product made by reconstituting concentrated fruit juice is described as ‘fruit juice from concentrate’. This Directive replaces the text ‘made with concentrate(s)’ and ‘partially made with concentrate(s)’ by the words ‘from concentrate(s)’ and ‘partially from concentrate(s)’ respectively.

MILK AND MILK PRODUCTS
Commission Decision 2010/791/EU (OJ L 336, p55, 21/12/2010) of 20 December 2010 listing the products referred to in the second subparagraph of point III(1) of Annex XII to Council Regulation (EC) No 1234/2007
Summary: Regulation (EC) No 1234/2007 establishes the principle that the descriptions milk and milk products may not be used for milk products other than those in described point II of Annex XII thereto. As an exception, this principle is not applicable to the description of products the exact nature of which is known because of traditional use and/or when the designations are clearly used to describe a characteristic quality of the product. This Decision lists those products . It repeals the previous legislation on this list which was set out in Decision 88/566/EEC is repealed
FOOD LABELLING – CLAIMS
Commission Regulation (EU) No 1161/2010 (OJ L326, p59, 10/12/2010) of 9 December 2010 refusing to authorise a health claim made on foods, other than those referring to the reduction of disease risk and to children’s development and health
Summary: Following an application pursuant to Article 13(5) of Regulation (EC) No 1924/2006 the health claim set out in the Annex to this Regulation will not be included in the EU list of permitted claims as provided for in Article 13(3) of Regulation (EC) No 1924/2006. However, in order to enable food business operators to adapt to the requirements laid down in this Regulation, it may continue to be used until 30th June 2011.
Commission Regulation (EU) No 1162/2010 (OJ L326, p61, 10/12/2010) of 9 December 2010 refusing to authorise certain health claims made on foods and referring to the reduction of disease risk and to children’s development and health
Summary: Following applications from 2 companies submitted pursuant to Article 14(1)(b) of Regulation (EC) No 1924/2006, the health claims set out in the Annex to this Regulation are not permitted in the EU list of permitted claims as provided for in Article 14(1) of Regulation (EC) No 1924/2006.
Commission Decision 2010/770/EU (OJ L328, p18, 30/12/2008)of 13 December 2010 amending Decision 2009/980/EU as regards the conditions of use of an authorised health claim on the effect of water-soluble tomato concentrate on platelet aggregation
Summary: This Decision extends the use of the health claim for Water-Soluble Tomato Concentrate (WSTC) I and II on the blood platelet activity in healthy people to foods other than those already authorised by Commission Decision 2009/980/EU. The claim now extents the conditions of use to include a daily consumption of 3 g WSTC I or 150 mg WSTC II in food

Commission Regulation (EU) No 1121/2010 (OJ L317, p14, 03/12/2010) of 2 December 2010 entering a designation in the register of protected designations of origin and protected geographical indications [Edam Holland (PGI)]
Summary: This Regulation approves the application of the Netherlands to enter the designation ‘Edam Holland’ in the register of protected designations of origin and protected geographical indications. Pursuant to the second sub- paragraph of Article 13(1) of Regulation (EC) No 510/2006, the name ‘Edam’ may continue to be used provided the principles and rules applicable in the EU’s legal order are respected
Commission Regulation (EU) No 1122/2010 (OJ L317, p22, 03/12/2010) of 2 December 2010 entering a designation in the register of protected designations of origin and protected geographical indications [Gouda Holland (PGI)]
Summary: This Regulation approves the application of the Netherlands to enter the designation ‘Gouda Holland’ in the register of protected designations of origin and protected geographical indications. Pursuant to the second sub- paragraph of Article 13(1) of Regulation (EC) No 510/2006, the name ‘Gouda’ may continue to be used provided the principles and rules applicable in the EU’s legal order are respected

WINE
Commission Regulation (EU) No 1266/2010 (OJ L347, p27, 31/12/2010) of 22 December 2010 amending Directive 2007/68/EC as regards labelling requirements for wines
Summary: Pending the scientific assessment by EFSA regarding casein and ovalbumin used in the manufacture of wine as clarification processing aids , the mandatory application to the wine sector of Directive 2007/68/EC is postponed.
Therefore this Regulation permits wines, as defined in Annex XIb to Regulation (EC) No 1234/2007, placed on the market or labelled before 30 June 2012, and which comply with the provisions of Directive 2005/26/EC, to be marketed until stocks are exhausted.
