Food Additives other than colours and sweeteners

European Communities (Food Additives other than colours and sweeteners) (Amendment) Regulations 2011 (S.I. No 93 of 2011)

Summary: This S.I. gives further effect to European Parliament and Council Directive 95/2/EC, as amended by Directive 2006/52/EC of the European Parliament and of the Council of 5 July 20062 and Commission Directive 2010/69/EU.

Directive 2010/69/EU amended Annexes II to VI to Directive 95/2/EC by extending the use of some food additives e.g. permitting the use of L-cysteine (E920) in biscuits for infants and young children, as well as authorizing the use of a number of new additives and assigning ‘E’ numbers to those new additives. Included in the list of new additives are:

  • Polyvinyl alcohol (PVA) as a film-coating agent for food supplements that are in the form of capsules and tablets. It has been assigned the E number E 1203
  • Cassia gum acting as gelling agent and thickener, it has been assigned E 427 as its E number

 

Plastics and other materials intended to come into contact with foodstuffs

European Communities ( Plastics and other materials)(Contact with foodstuffs) (Amendment) Regulations 2011 (S.I. No 105 of 2011)

Summary: This SI gives gives effect to Council Directive No. 2011/8/EU insofar as it restricts the manufacture of polycarbonate infant feeding bottles. It also revokes the European Communities (Plastics and other materials) (Contact with food) (Amendment) Regulations 2010 (S.I. No. 301 of 2010)

Bovine spongiform encephalopathy (BSE)/Transmissible spongiform encephalopathies (TSE)

Commission Regulation (EU) No 189/2011 (OJ L53, p56, 26/02/12011) of 25 February 2011 amending Annexes VII and IX to Regulation (EC) No 999/2001 of the European Parliament and of the Council laying down rules for the prevention, control and eradication of certain transmissible spongiform encephalopathies

Summary: This Regulation amends Annexes VII and IX to Regulation (EC) No 999/2001

Food Hygiene

Commission Regulation (EU) No 150/2011 (OJ L46, p14, 19/02/2011) of 18 February 2011 amending Annex III to Regulation (EC) No 853/2004 of the European Parliament and of the Council as regards farmed and wild game and farmed and wild game meat

Summary: This Regulation amends Annex III to Regulation (EC) No 853/2004 by inserting text into Section III, point 3a which permits for the attestation of the correct slaughter and bleeding, as well as of the date and time of slaughter, to be made by the food business operators instead of by the official or approved veterinarian if certain criteria are met. The Regulation also replaces point 4(a) of Chapter II of Section IV, in regard to slaughtering of wild game 

Commission Regulation (EU) No 151/2011  (OJ L46, p17, 19/02/2011) of 18 February 2011 amending Annex I to Regulation (EC) No 854/2004 of the European Parliament and of the Council as regards farmed game

Summary: This Regulation includes a sample copy of the Health Certificate for slaughtered game which must be used by a food business operator. It also amends Part A of Chapter VII of Regulation (EC) No 854/2004

Border Inspection posts

Commission Decision 2011/93/EU (OJ L37, p25, 11/02/2011) of 10 February 2011 amending Decision 2009/821/EC as regards the lists of border inspection posts and veterinary units in Traces

Summary: This Decision amends the list of border inspection posts approved in accordance with Directives 91/496/EEC and 97/78/EC. It also makes certain changes to the list laid down in Annex II to Decision 2009/821/EC in regard to central, regional and local units in Traces for certain Member States ( including Ireland )

Corrigendum( OJ L63, p28, 10/03/2011) to Commission Regulation (EU) No 144/2011 of 17 February 2011 amending Regulation (EU) No 206/2010 laying down lists of third countries, territories or parts thereof authorised for the introduction into the European Union of certain animals and fresh meat and the veterinary certification requirements ( OJ L 44, 18.2.2011)

Summary: This Regulation amends Annexes I and II to Regulation (EU) No 206/2010 with regard to the third countries that can export to the EU and the conditions attached to those animal products. 

Commission Decision 2011/131/EU (OJ L53, p73, 26/02/2011) of 25 February 2011 amending Annex II to Decision 2006/766/EC as regards the inclusion of Fiji in the list of third countries and territories from which imports of fishery products for human consumption are permitted

Summary: This Decision amends Decision 2006/766/EC by including Fiji in the list in Annex II to Decision 2006/766/EC as a third country from which imports of fishery products intended for human consumption are permitted.

Novel Foods

Commission Decision 2011/73/EU (OJ L29, p30, 03/02/2011) of 2 February 2011 authorising the placing on the market of a mycelial extract from Lentinula edodes (Shiitake mushroom) as a novel food ingredient under Regulation (EC) No 258/97 of the European Parliament and of the Council

Summary: This Decision authorises the placing on the EU market of mycelial extract from Lentinula edodes as specified in Annex I to the Decsion as a novel food ingredient for the uses listed in Annex II to the Decision . It must be labelled as ‘extract from the mushroom Lentinula edodes’ or ‘extract from the Shiitake mushroom’. 

Commission Decision 2011/76/EU (OJ L29, p34, 03/02/2011) of 2 February 2011 authorising the placing on the market of a chitin-glucan from Aspergillus niger as a novel food ingredient under Regulation (EC) No 258/97 of the European Parliament and of the Council

Summary: This Decision authorises the placing on the EU market of Chitin-glucan from Aspergillus niger as specified in the Annex to the Decision as a novel food ingredient to be used in food supplements with a maximum dose of 5 g per day. It must be labelled as ‘chitin-glucan from Aspergillus niger’ on foodstuffs authorised to contain it. 

Commission Decision 2011/80/EU (OJ L31, p48, 05/02/2011) of 4 February 2011 authorising the placing on the market of a fish (Sardinops sagax) peptide product as a novel food ingredient under Regulation (EC) No 258/97 of the European Parliament and of the Council

Summary: This Decision authorises the placing on the EU marker of fish (Sardinops sagax) peptide product as specified in Annex I to the Decision as a novel food ingredient for the uses listed in Annex II to the Decision. It must be labelled on permitted foods as ‘fish (Sardinops sagax) peptides’.

Commission Regulation (EU) No 87/2011 (OJ L29, p1, 03/02/2011) of 2 February 2011 designating the EU reference laboratory for bee health, laying down additional responsibilities and tasks for that laboratory and amending Annex VII to Regulation (EC) No 882/2004 of the European Parliament and of the Council

Summary: The Agence Nationale de Sécurité Sanitaire de l’alimentation, de l’environnement et du travail (ANSES), with its research laboratory for bee diseases, Sophia-Antipolis Laboratory, France, is designated as the EU reference laboratory in the field of bee health, for a period of five years from 1 April 2011. In addition to the general functions and duties laid down in Article 32(2) of Regulation (EC) No 882/2004, additional specific responsibilities and tasks of the EU reference laboratory in the field of bee health are set out in this Regulation. Part II of Annex VII to Regulation (EC) No 882/2004 is amended accordingly. 

Commission Regulation (EU) No 187/2011 (OJ L53, p45, 26/02/2011) of 25 February 2011 amending Annex I to Regulation (EC) No 669/2009 implementing Regulation (EC) No 882/2004 of the European Parliament and of the Council as regards the increased level of official controls on imports of certain feed and food of non-animal origin

Summary: Commission Regulation (EC) No 669/2009 lays down rules concerning the increased level of official controls to be carried out on imports of feed and food of non- animal origin listed in Annex I to that Regulation at specified points of entry. This list of imports is reviewed on a regular basis and taking into account of information received since the previous amendment, this Regulation makes some changes to the level of official controls on imports of certain feed and food of non-animal origin.

Commission Regulation (EU) No 91/2011 (OJ L30, p15, 04/02/2011) of 2 February 2011 entering a name in the register of protected designations of origin and protected geographical indications (Hofer Rindfleischwurst (PGI))

Summary: This Regulation approves Germany's application to register the name ‘Hofer Rindfleischwurst’ in the register of protected designations of origin and protected geographical indications

Commission Regulation (EU) No 92/2011 (OJ L30, p17, 04/02/2011) of 3 February 2011 approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications [Salame Piacentino (PDO)]

Summary: This Regulation approves Italy’s application to amend the specification for the protected designation of origin ‘Salame Piacentino’ registered under Commission Regulation (EC) No 1107/96, as amended by Regulation (EC) No 1263/96 

Commission Regulation (EU) No 93/2011  (OJ L30, p19, 04/02/2011) of 3 February 2011 approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications [Fontina (PDO)]

Summary: This Regulation approves Italy's application to amend the specification for the protected designation of origin ‘Fontina’ registered under Commission Regulation (EC) No 1107/96

Commission Regulation (EU) No 94/2011 (OJ L30, p21, 04/02/2011 of 3 February 2011 entering a name in the register of protected designations of origin and protected geographical indications [Carciofo Spinoso di Sardegna (PDO)]

Summary: This Regulation approves Italy’s application to register the name ‘Carciofo Spinoso di Sardegna’ in the register of protected designations of origin and protected geographical indications 

Commission Regulation (EU) No 95/2011 (OJ L 30, p23, 04/02/2011) of 3 February 2011 entering a name in the register of protected designations of origin and protected geographical indications [Arancia di Ribera (PDO)]

Summary: This Regulation approves Italy's application to register the name ‘Arancia di Ribera’ in the register of protected designations of origin and protected geographical indications

Summary: This Regulation approves Italy’s application to register the name ‘Limone di Siracusa’ in the register of protected designations of origin and protected geographical indications 

Commission Regulation (EU) No 97/2011 (OJ L30, p27, 04/02/2011) of 3 February 2011 approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications [Welsh Beef (PGI)]

Summary: This Regulation approves the United Kingdom’s application to amend the specification for the protected geographical indication ‘Welsh Beef’ registered in accordance with Commission Regulation (EC) No 2400/96 ( 2 ), as amended by Regulation (EC) No 2066/2002 

Commission Regulation (EU) No 106/2011 (OJ L32, p3, 08/02/2011)of 7 February 2011 approving non-minor amendments to the specification for a name entered in the register of protected designations of origin and protected geographical indications [Cerezas de la Montaña de Alicante (PGI)]

Summary: This Regulation approves Spain's application to amend the specification for the protected geographical indication ‘Cerezas de la Montaña de Alicante’, registered under Commission Regulation (EC) No 1107/96

Information Note: Consumption of brown crab meat

 Information Note - Consumption of brown crab meat  - Crabs and crab like crustaceans can contain high amounts of cadmium in their main body. This is often referred to as “brown crab meat”. An EU wide maximum level is established for meat from legs and claws (white meat) as these are the parts of crabs mostly consumed in the EU. However, in some EU countries consumers do consume brown crab meat’. This EU information note is of relevance to those consumers.
