Regulation (EU) 2017/625 of the European Parliament and of the Council of 15 March 2017 on official controls and other official activities performed to ensure the application of food and feed law, rules on animal health and welfare, plant health and plant protection products (OJ L 095, p1, 7/4/2017), as amended, replaces former Council Directive 96/23/EC on measures to monitor certain substances and residues thereof in live animals and animal products.
Regulation (EU) 2017/625, as amended, requires Member States to perform risk-based official controls with appropriate frequency, at any stage of production, processing and distribution on relevant substances whose use or presence on crops or animals or to produce or process food or feed may result in residues of those substances in food or feed.
Regulation (EU) 2017/625, as amended, also specifies that Member States shall ensure official controls are performed by means of a multiannual control plan (MANCP) coordinated within their Member State by a single body and results are reported annually to the European Commission.
There are temporary increased controls for some foods of non-animal origin imported or consigned from certain third countries. This is due to a known or emerging risk, or because of widespread non-compliance with food law. Annex I of Regulation 2019/1793 on the temporary increase of official controls and emergency measures governing the entry into the European Union of certain goods from certain third countries (see the section on Imports) lists the food of non-animal origin subject to a temporary increase of controls at border control posts. This list is reviewed by the European Commission at least twice a year.
